3. Eligibility. Subject to the additional restrictions below, the “Kid Wisdom Kid Quote Contest ” is open to legal US residents of the 50 United States who are 18 years or older at the time of entry.

Restrictions. Employees, officers and directors of Sponsor and Promoters, their respective related companies and agents, as well as the immediate family (defined as parents, spouse, children, siblings and grandparents) and household members of each such employee, officer and director are not eligible to enter. By participating, entrant agrees to abide by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.

4. Entries are limited to the following methods. Online through the form at this site. Alternate entry is by mailing, in a standard envelope, a 4x6 inch index card with your NAME, ADDRESS, CITY, STATE, ZIP CODE, PHONE NUMBER, AGE, CHILD'S NAME, QUOTE, and AGE OF THE CHILD AT THE TIME OF THE QUOTE printed in block letters to:

All entries (quotes) must be under 175 characters and be received by 06/30/09 to be valid. Illegible entries will be considered void. All entries become the exclusive property of Lil Sophisticate, and none will be acknowledged or returned. Proof of sending will not be deemed to be proof of receipt by Sponsor.

Contestants acknowledge and agree that Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, create a sound recording of, broadcast, or otherwise display or use entries in any way it sees fit without limitation or compensation to entrants.

Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. Sponsor further reserves the right to disqualify any entry that is alleged to infringe on any third-party’s intellectual property rights, or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience.

All quotes selected as a finalist will randomly appear on the right hand side of all of our pages in the box entitled "Kid Wisdom".

5. Winner Selection. On or about 07/15/09, Sponsor will select one (1) winner from among all entrants. Entrant selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email within three (3) days for notification. The potential winner must respond within three (3) days. Within three (3) days from receipt of winners address release.

No substitution, assignment or transfer of prize permitted. Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use. Winners of prizes or awards in excess of $500.00 will receive a tax form MISC-1099 to declare their winnings for tax purposes.

7. Except where prohibited, participation in the $500.00 eGift Card constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, hometown and state for promotional purposes in any media without further payment or consideration.

8. Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage Sponsor's or any Promoter's Web site or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor and Promoters reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by appropriate NC State Court located closest to Flat Rock, NC; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LINCTATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsor and Promoter in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of NC, without giving effect to any choice of law or conflict of law rules (whether of the State of NC or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of NC. All federal, state and local laws and regulations apply. Entrant agrees to receive at least one (1) email newsletter to the email address supplied by the entry process after which the entrant may opt-out, afterwhich the Name and address stored in the newsletter database will be deleted.

10. Participation. By participating, contestants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.

11.Copyright. By entering the Contest, each contestant grants to Sponsor an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the contestant’s submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation.
